Privacy Policy
This policy covers information about you as a Client of Normal Modes, ("the NM Service," or "Service"), including the personal information we collect through the sites, services and software that we use to provide you our Service.
Collection of Your Information
Your NM Client information consists of personally identifiable information collected or received about you when you interact with the NM Service, including the NM website and server, and software. Depending on how you use the NM Service, your NM Client information may include:
- registration-related information (such as name, home or work addresses, e-mail addresses, telephone and fax numbers);
- information about your visits to NM website, and your responses to the offerings and advertisements presented on these sites and pages;
- information about the searches you perform through the NM Service and how you use the results of those searches;
- information about the NM Services that you use and how frequently you use them;
- information about your NM preferences (such as a zip code for localization purposes);
- transaction-related information (such as credit card or other preferred means of payment, billing or shipping information, or a history of products purchased through the NM Service);
- customer service information about you as an NM Client (such as account history, your or others' complaints, and your interactions with NM support services online or by phone); or
- other information specifically related to your use of a particular NM Service offering.
Your NM Client information may also include certain technical and diagnostic information gathered or received when you use the NM Service. Some of the technical information that may be collected or received includes: the type of browser you are using (e.g., Netscape, Windows Explorer), the type of operating system you are using (e.g., Windows or Mac OS), CPU type, the manner in which you connect to the Internet (e.g., connection speed through narrowband or broadband access); Internet protocol address; other information about your geographic location; or data relating to computer malfunctions or problems occurring when you use your computer with the NM Service.
Your NM Client information may be supplemented with additional information, including publicly-available information and information from other companies.
Rackspace Provisions
The NM Service uses RackSpace, or similar technologies, to provide internet service, hosting, data storage, authentication and access to NM Services. More information about RackSpace is available at http://www.rackspace.com. The following information is provided by Rackspace:
When Rackspace is a data controller, Rackspace adheres to the Safe Harbor Principles (Notice, Choice, Onward Transfer, Security, Data Integrity, Access and Enforcement) as described in the Rackspace Privacy Statement, with respect to the personal data we collect from data subjects, such as information regarding service requests, service orders, handling orders, delivering services and processing payments; and have certified our compliance with the Safe Harbor Framework to the United States Department of Commerce. When Rackspace is a data processor Rackspace's obligations with respect to personal data for which Rackspace is solely a data processor, such as personal data that Rackspace customers store or transfer using Rackspace's technology hosting services, are defined in its agreements with its customers and are not from the EU as an agent of the customer merely for processing and is not required to apply Safe Harbor principles to that information. The customer will remain responsible for the personal data that it collects and processes and for the compliance with applicable data protection laws.
Opting Out of Communications
Rackspace gives you an opportunity to chose to opt-out of personal data being disclosed to third parties for a purpose incompatible with the purpose for which it was originally collected (except for meeting applicable legal requirements or permitting third party service providers who perform functions on our behalf as described in section 3 of this Privacy Statement), including your opting out of receiving future marketing mailings. We will not use your contact information to correspond with you about our services if you ask us not to. Please note that it may take up to ten days to remove your contact information from our marketing communications lists, so you may receive correspondence from us for a short time after you make your request.
Security of Your Information
Rackspace is committed to industry best practices approaches concerning security measures to prevent loss, misuse and alteration of the information in our possession. We use various security measures to protect the information we collect, as appropriate to the type of information, including encryption, firewalls, and access controls. We store information you provide to us on a computer system located in a controlled facility with a limited access. Visitor textual information employees, contractors and agents on a need to know basis and who have entered into and are bound by a confidentiality and nondisclosure agreement with Rackspace.
How Your NM Client Information Is Used
Your NM Client information may be used:
- to operate and improve the NM Service;
- to fulfill your requests for products, programs, and services;
- to communicate with you and respond to your inquiries;
- to conduct research about your use of the NM Service; and
- to help offer you other products, programs, or services that may be of interest.
NM does not rent or sell your NM Client information (such as name, address, telephone number, screen name and credit card information) to third parties. We may share NM Client information in order to jointly present you offers with or on behalf of our business partners, but we do not allow these partners to use your NM Client information for any other purpose. Except for these joint offers, NM will only share your NM Client information with third parties to provide products and services you have requested, or when we have your consent
NM may use agents and contractors in order to help operate the NM Service. We require agents and contractors that have access to NM Client information to protect this information in a manner consistent with this Privacy Policy, and prohibit them from using the information for any purpose other than to carry out the services they are performing for the NM Service.
In the event that ownership of the NM Service was to change as a result of a merger, acquisition, or transfer to another company, your NM Client information may be transferred. If such a transfer would result in a material change in the use of your NM Client information, we will provide notice about the choices you have to decline to permit such a transfer.
Cookies
The NM Service may use cookies and similar technologies in combination with your NM Client information to facilitate your use of the NM Service to help authenticate you when you use the NM Service; to remember your preferences and registration information; to enable a shopping cart; to present and help measure and research the effectiveness of NM Service offerings, advertisements, and e-mail communications (by determining which NM Service e-mails you open and act upon); and to customize the content and advertisements provided to you through the NM Service.

Keeping You Informed about Changes to this Policy
The NM Service may update this Privacy Policy from time to time, and so you should review this Policy periodically. If we make minor changes or clarifications to this Policy, we will give you notice online through NM, such as through the NM Service Welcome page or on our main NM Service Web sites and pages. If the Policy changes are substantial, we will notify you 30 days' in advance of such changes taking effect, such as through e-mails or online pop-up screens. You should sign on to your account regularly for these and other important announcements. You may be provided additional privacy-related information and choices in connection with your use of other offerings from the NM Service, as well as for special features and services not described in this Policy that may be introduced in the future.
